DISCUSSION QUESTIONS

  1. How does the structure of the federal government contribute to Indian affairs?
  2. How was the John Marshall court both pro-Indian and anti-Indian?  What were the effects of this?
  3. How did the relationship of the federal government to the Indians evolve and how did this change Indian affairs?
  4. Why did the chief justices of the Marshall court disagree?  How did the same court come to two contradictory decisions in the Cherokee Nation Cases?
  5. How does the role of the president affect Indian affairs?  How was President Jackson able to remove the Indians despite the rulings of the Supreme Court?
  6. What allows the Indians to be at the mercy of Congress?  How has this affected Indian matters?
  7. Why was the Supreme Court so supportive of the Indians?  Why did the presidents and other major figures that contributed to Indian history feel the same way?
